New block exemption rules to impact aftermarket sector competitiveness

The European Commission (EC) today adopted a new set of rules and guidelines that relate to access to technical information and alternative spare parts. The new Block Exemption regulations will affect interactions between independent service and repair garages, authorised repairers, vehicle manufacturers and spare parts distributors.

Paul Everitt, SMMT chief executive said, “Industry welcomes the EC’s recognition of the high level of competition in the automotive sector and the differences between the primary and after markets. It is supportive of the new ruling as it is important that motorists have the widest choice possible within the aftermarket sector.”
 
Under the new rules, the general block exemption regulations would apply to the primary [sales] market (delayed until 1 June 2013); whilst an additional block exemption ruling, will apply to the aftermarket applicable from 1 June 2010. Despite the change in legislation the actual regulatory framework will be largely unaltered for the aftermarket.
